Adoption Documents Required At U.S. Embassy in Ukraine

When finalizing your adoption in Ukraine, the US Embassy requires that you have certain documentation completed and translated for their review in order to give you an IR-3 immigrant visa that will allow your child to emigrate from Ukraine.

As adoption facilitators, Embrace A Child - Ukrainian Adoptions LLC. will be to help you with your paperwork and to gather and translate all needed documents for your final meeting with the U.S. Embassy consular officer.  The following gives you an overview of the required documents.

 

WHAT IS AN IR-3 IMMIGRANT VISA?

IR-3 (Immediate Relative) visas state that an orphan has been adopted in a foreign country before the issuance of the immigrant visa.  The adoption must be validated in order to be legal in the country where the adoption occurred and the adoption must be valid for U.S. immigration purposes.  IR-3 immigrant visas pertain to orphans that have been fully adopted overseas by both parents.  Both parents must have physically seen the child before or during the adoption processes in Ukraine.

FINAL ADOPTION DOCUMENTS CHECKLIST AT US EMBASSY IN UKRAINE.

(IR-3 IMMIGRANT VISA REQUIREMENTS IN UKRAINE AND IR-3 IMMIGRANT VISA REQUIREMENTS DETAILS.)  

PART I: Ukrainian adoption documents with English translations 

(One set of documents, in addition to the originals, is required for EACH child.)

     ORIGINALS of the adoption court decree granting adoption and childs new birth certificate with new adopted name (they do not have to be apostilled for the time of the interview; originals will be returned to you).  Make two copies of both documents.

     Two copies of the child's pre-adoption birth certificate accompanied by an English translation.

     Two copies of abandonment documents: a Ukrainian court decree declaring that the child is an orphan and no surviving birth parents have any legal parental rights under Ukrainian law/abandonment letter/act, with an English translation.

     Two copies of the Ukrainian adoption court decree accompanied by an English translation.

     Two copies of the childs new birth certificate accompanied by English translation.

     Two copies of the orphanage's medical report/medical history for the child.

PART II: Forms to be completed prior to the interview; other requirements

     Approved I-600A Form (Application of Advanced Processing of Orphan Petition)This form is used by USCIS to adjudicate the qualifications of the applicant(s) as prospective adoptive parents. Filing this form will generally speed up the part of the processing relating to the qualifications of the prospective adoptive parent petitioner(s).   Note: Can be done in the US as long as notarized.

     Completed I-600 petition (Petition to Classify Orphan as an Immediate Relative), with original signatures of both adopting parents. To classify an alien orphan who is, or will be, adopted by a U.S. citizen as an immediate relative of the U.S. citizen in order to allow the child to enter the U.S.  The petition is filed by the US citizen who is adopting the child. www.uscis.gov/graphics/formsfee/index.htm

     Completed immigrant visa application, Form DS-230, Parts I and II (Application for Immigrant Visa and Alien Registration) signed by one parent on behalf of the child, in the presence of a US consular officer. www.kiev.usembassy.gov/files/ds-230.pdf

     Completed Acknowledgement of Health Problems of Adopted Child, signed in the presence of a consular officer at the US Embassy in Ukraine or notarized in the U.S.  If an adopted child has any kind of health problems (defect, disability or disease), however minor, the U.S. law requires that both adopting parents sign acknowledgments that they are aware of the childs health problem and are willing to adopt the child regardless. www.kiev.usembassy.gov/files/healthaffdvt.rtf   Note: Can be done in the US as long as notarized.

     Affidavit of Vaccinations Requirement Waiver (only for children 10 and younger) signed in the presence of a US consular officer or notarized in the U.S. www.kiev.usembassy.gov/files/vaccineaffdvt.rtf   Note: Can be done in the US as long as notarized.

     Immigrant visa fee of $380 (includes application fee of $335 plus a surcharge of $45) for each child (if a second adopted child is unrelated to the first one, an additional I-600 application fee of $545 is also charged) payable in U.S. cash only to the US Embassy in Ukraine cashier.

     Original and a copy of adopting parents passports. Note: Can be done in the US as long as notarized.

     One 50 mm x 50 mm frontal facial view photograph of the child with light background on glossy paper, unretouched, and unmounted (please see the photo requirements below).  A new passport will be issued with the frontal facial photograph of the child/children. www.kyiv.usembassy.gov/amcit_ivphoto.eng.html  

     Medical examination (sealed envelope) by the US Embassy-designated panel physician (American Medical Center or Clinic of the Oil-Refining Industry of Ukraine). DO NOT OPEN AND BREAK THE SEAL OF THE ENVELOPE.

     Childs Ukrainian passport (original).  Make a copy.

     Job Letter, Tax Forms (1040/W-2).  Two copies notarized.  Note: Must be done in the US.

      All forms mentioned in this checklist are available on the US Embassys website: http://www.usembassy.kiev.ua/amcit_adoptions_eng.html. You can also request them by sending an e-mail to adoptionskiev@state.gov, or alternatively may pick them up at the Consular Section

      Every non-English-language document must be accompanied by an official English translation.  (Translations should be certified by a translators or agencys stamp, or notarized.)  English translations should be stapled or clipped to each corresponding Ukrainian document, but please do not staple ALL documents together.

      Make sure to keep another full set of Ukrainian documents with English translations for your records.  (Only the childs original birth certificate and adoption court decree will be returned to parents after the interview.)  All other documents you submit to the Embassy will not be returned.

Photograph Requirements (for adopted children)

       Color full-frontal view printed on a white background.  Colored or patterned backgrounds are not acceptable.

       Show the applicant facing straight ahead, looking neither down nor to the side, with applicants head centered in the frame and applicants ears exposed.

       Measure 50 mm square.  The applicants head (measured from top of the hair to the bottom of the chin) must measure 25 mm to 35 mm; the applicants eye level must be 28 mm to 35 mm from the bottom of the photo.
